Note for:   Benjamin Franklin Kelly,   11 APR 1867 - 2 SEP 1902         Index

Occupation:
     Place:   Livery Business

Burial:
     Place:   Fairland Cemetery, Ottawa, Oklahoma

Individual Note:
From an email to Eric Andersen from Chuck Pierce dated April 13, 2000:

"Benjamin Kelly married Margaret Elizabeth Miller in the Delaware District of Indian Territory April 30, 1885. Margaret claims 1/32 Cherokee blood, Dawes roll number 26463. Margaret was probably born in the Flint District of Indian Territory as that's where her parents lived from around 1856 until they moved to the Delaware District in the 1880s around Careys Ferry. Careys Ferry was covered when Grand Lake was made by damming the Grand River in the 1930s. The location of Careys Ferry would almost be within the city limits of present day Grove, OK. Margaret was born April 17, 1870 and died Sept. 27, 1909 and is buried in the Fairland cemetery along with Ben. Margaret's parents were Robert C. Miller and Mary Lamar, with the Indian blood coming from Mary Lamar. Robert was white and migrated to Indian Territory after the Civil war from Tenn. where his family was supposed to have had a plantation. I do have more information about the Lamar and Paden families if you can use it . The Padens were Mary Lamar's mother's family. These families were considered mixed breeds and were connected with the Treaty Party or Progressive Indian that realized they had to take whiteman's ways to survive. Many of the family's members served with Stand Watie in his Cherokee mounted rifles in the Civil war, of course the story of the Civil war is a whole other story.

Margaret and Ben had three children. Ernest H. Kelly born Dec. 24, 1889, Delaware District and died May 11, 1961 at Fairland, OK and is in the Fairland cemetery. Fannie May Kelly born March 11, 1893 Delaware District and died March 18, 1989 at Fairland, OK and is in the Fairland cemetery. This is my grandmother. And Clyde B Kelly born November 25, 1900 Delaware District and died November 8, 1972, Chicago, Ill.

Benjamin had made application for Indian allotment as a Cherokee Nation citizen by intermarriage but died just before the cutoff date and land was never allotted to him. Land was allotted to the rest of the family around the Fairland area. I have the Original certificates that describes the land my grandmother received. Both Ben and Margaret died so young that no one remembered much about them. I have the obit from the Fairland paper for Margaret but haven't located one for Ben.

Ernest left Fairland soon after his mother died for Chicago and became a steel worker. When he left he was supposed to have taken all the family money with him so he became an outcast. I believe he married but don't know of children. He returned to Fairland when he was old and sick and my grandfather refused to allow my grandmother to care for him. One of my uncles cared for him until he died.

Clyde Kelly also moved to Chicago and married. He became a catholic and had a large family. I don't have all on his family but there are many still around Chicago if you need that. Fannie Kelly married Avery Fairchild Marshall of Sarcoxie, MO on October 24, 1907 at Vinita, OK. Avery was born March 13, 1884 and died Sept 30,1960 in Fairland, OK and is buried at the Fairland cemetery. The Marshall family had been in the Fairland area for some time and my grandmother was quite young when they married, her marriage cert say she's 18 but she wasn't. They had six children which one was my mother. Today only two survive, my mother is one of them." [From Chuck Pierce]

Note for:   Rebecca R. Mauck,    - ABT 1885         Index

Individual Note:
From Joe McKee in the Mock Family Historian Newsletter, Aug. 2000:

"Rebeca Mauck married the widower Henry P. Aleshire, one of Peggy (Aleshire) Mauck's brothers. I can document what happened to Rebecca and Henry after they left Page county circa 1832. Henry and Rebecca had no children that I have discovered, although Henry had at least a daughter and probably a son by his first marriage to Priscilla Burner. After Henry P. Aleshire died in 1868, Rebecca lived in Seneca County, Ohio with her sister Martha (Mauck) (Hershberger) Seitz in 1870. In 1878 and 1880 Rebecca was living with a brother, Isaac Mauck, and his family in Muscatine, Iowa. Rebecca apparently died there in about 1885 according to Henry Aleshire's War of 1812 pension records."
